2. Age Requirements and Content Advisory

3. Use License

Permission is granted to temporarily access the materials on Get Low's website for personal, non-commercial viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Attempt to decompile or reverse engineer any software contained on Get Low's website
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

Users may post content as long as it is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable.

6. Premium Services

Some features of our service require payment. By subscribing to a premium service, you agree to pay all fees in accordance with the billing terms. Fees are non-refundable except where required by law.

7. Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Limitation of Liability

In no event shall Get Low, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.

10. Payment Processing and Refunds

By making a purchase on Get Low, you agree to the following terms:

• All payments are processed securely through our payment provider (Stripe)
• Prices are listed in USD and include applicable taxes
• Subscription fees are billed automatically until cancelled
• Virtual items and currency purchases are final and non-refundable
• Refunds may be considered for technical issues preventing service access
• Chargebacks without contacting support first may result in account suspension

11. User-Generated Content

When you create, upload, or share content on Get Low, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content
• The right to moderate or remove content that violates our guidelines
• Permission to feature your content in promotional materials (with attribution)

You retain ownership of your content and represent that:

• You own or have permission to use and share the content
• Your content doesn't infringe on others' rights
• Your content complies with our community guidelines

12. Server Rules and Competitive Play

Server Rules

• No cheating, hacking, or exploitation of game mechanics
• No use of unauthorized third-party software or modifications
• No intentional disruption of server performance
• No impersonation of other players or staff
• Respect server-specific rules and guidelines

Competitive Play

• Players must be eligible for their competitive division
• Match results are final unless clear technical issues occurred
• Prize distribution follows our competition guidelines
• Competitive bans may be issued for rule violations
• We reserve the right to modify competition rules

13. Modifications and Cheating

The following activities are strictly prohibited:

• Using unauthorized game modifications
• Exploiting bugs or glitches
• Using automation tools or bots
• Manipulating game files
• Sharing or selling cheats/hacks

Violations may result in:

• Immediate account suspension
• Permanent account termination
• Competition disqualification
• Forfeiture of virtual items or currency

14. Account Termination

We may terminate or suspend your account for:

• Repeated or severe rule violations
• Fraudulent activity or payments
• Sharing account credentials
• Extended period of inactivity
• Violation of age restrictions

Upon termination:

• Access to services will be revoked
• Virtual items and currency will be forfeited
• Subscription fees will not be refunded
• Content may be removed or retained at our discretion

15. Legal Disclosures and Compliance

Required Disclosures

We reserve the right to disclose any information about you or your use of the Service:

• To satisfy any applicable law, regulation, legal process, or governmental request
• To enforce this Agreement, including investigation of potential violations
• To detect, prevent, or otherwise address fraud, security, or technical issues

Law Enforcement Cooperation

• We fully cooperate with law enforcement authorities
• We may disclose user identities when required by law
• You agree to hold us harmless from any claims resulting from our cooperation with authorities

Export Compliance

By using the Service, you represent and warrant that:

• You are not located in a U.S. Government embargoed country
• You are not on any U.S. Government list of prohibited or restricted parties
• You will comply with all applicable export control laws

15. Refund Policy

Subscription Services

For subscription services (Precision, Stuntman, and Supporter tiers):

• You may request a refund within 48 hours of your initial purchase if you haven't used any premium features
• Refunds are not available for subscription renewals
• Cancellations will take effect at the end of your current billing period

Eligibility for Refunds

Refunds may be considered in the following circumstances:

• Technical issues preventing access to premium features (must be reported within 24 hours)
• Accidental or duplicate purchases (must be reported within 48 hours)
• Service unavailability exceeding 24 continuous hours

Non-Refundable Items

The following are not eligible for refunds:

• Virtual items or currency once used or claimed
• Subscriptions active for more than 48 hours
• Accounts terminated due to violations of our Terms of Service
• Subscription time remaining after cancellation

How to Request a Refund

To request a refund:

1. Contact us at barry@getlow.gg with your purchase details
2. Include your username and transaction ID
3. Explain the reason for your refund request
4. Provide any relevant screenshots or information

We will review your request and respond within 2-3 business days. Approved refunds will be processed to the original payment method.

16. Binding Arbitration

Agreement to Arbitrate

Any dispute or claim relating to this Agreement or your use of the Service will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver

YOU AND GET LOW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration Procedures

• Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules
• The arbitration will be conducted virtually unless both parties agree to an in-person proceeding
• If an in-person proceeding is agreed upon, it will take place in a mutually agreed location that is reasonably convenient for both parties
• The arbitrator has exclusive authority to resolve all disputes

Opt-Out Right

You can choose to reject this arbitration agreement by emailing us at barry@getlow.gg within 30 days of accepting this Agreement.

17. Governing Law

This Agreement is governed by the laws of the State of California, without regard to its conflict of law principles. For any dispute not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the courts located within Los Angeles, California.

For EU Users

EU users may file complaints through the EU Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/.

18. Miscellaneous Terms

Force Majeure

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control.

Assignment

• We may assign this Agreement at any time without your consent
• You may not assign this Agreement without our prior written consent

Severability

If any part of this Agreement is found invalid or unenforceable, the remaining portions will remain in full force and effect.

No Waiver

Our failure to enforce any provision of this Agreement will not be considered a waiver of our right to enforce such provision.

Entire Agreement

This Agreement constitutes the entire agreement between you and us regarding the Service and supersedes all prior agreements and understandings.

Attorney's Fees

In the event of litigation, the prevailing party will be entitled to recover reasonable costs and attorney's fees.
